VAIN & MORTAL

Terms of Service

Effective and last reviewed: 24 August 2026.

These Terms of Service apply to consumer purchases made through the VAIN & MORTAL online store. Our Shipping & Delivery Policy and Returns & Refunds Policy form part of these terms. Our Privacy Policy and Cookie Policy explain how personal information is handled and do not reduce your consumer rights. Our legal and contact details are in our Contact Information.

1. Who we are

The seller is Chris Roys, a sole trader trading as VAIN & MORTAL / Vain and Mortal Alternative Clothing.

2. These terms and your rights

By placing an order you agree to these terms. Nothing here excludes, restricts or replaces rights under applicable consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3. Products

We take reasonable care to describe products accurately. Product photographs, digital mockups, colours and screen displays can differ from physical appearance. Any digital mockup is identified as such. Garment measurements are approximate unless stated otherwise.

Some products are produced or printed after you order. An ordinary catalogue product is not treated as personalised solely because it is printed to order. If we offer goods made to an individual specification or clearly personalised, any lawful change-of-mind exception will be identified before purchase.

4. Prices, taxes and delivery charges

Prices are shown in GBP and include applicable taxes where required. Delivery charges and the total payable are shown before you submit the order. If we discover a clear pricing error before acceptance, we may contact you for instructions or cancel and refund any amount paid.

5. Ordering steps, correcting errors and contract formation

The language offered for ordering and concluding a contract is English.

To place an order, you:

  1. choose a product and available options, such as size, and add it to the basket;
  2. review the basket, where quantities can be changed and products removed;
  3. enter or confirm contact, billing and delivery information and select an available delivery method;
  4. review the products, delivery method, delivery charge and total price, and choose a payment method; and
  5. submit the order using the final button labelled "Pay now" or another equally clear wording showing an obligation to pay.

Before submission, the basket and checkout let you identify and correct input errors, return to an earlier step, change or remove products, or stop without ordering. If you notice an error after submission, email support@vainandmortal.co.uk immediately. We will try to correct it but cannot promise a change after production or dispatch has begun.

Submitting an order is your offer to buy the goods shown. We acknowledge receipt electronically without undue delay. A contract is formed when we send the Order Confirmation email. A later dispatch email confirms fulfilment and shipment.

We may cancel an accepted order where reasonably necessary, including because a product is unavailable, payment cannot be completed, there is an obvious pricing or description error, we reasonably suspect fraud, or the address is outside an area we serve. We will explain where reasonably possible and refund any amount paid without undue delay.

Contract record and durable confirmation

We keep the order record in Shopify as explained in our Privacy Policy. We do not provide a separate public archive of concluded contract text. The Order Confirmation email is your contract confirmation and should be retained.

When the contract is formed, and no later than delivery, we provide confirmation by email in a form you can retain and reproduce unchanged. It must identify the goods and main characteristics, price, delivery charge, trader details and the contractual information that applies, including the cancellation information and model cancellation form. A website link may be provided for convenience, but a later webpage change does not change the information supplied for an existing contract.

You may save or print the terms and policies displayed before ordering. You may also ask us for information about an order record.

Codes of conduct

VAIN & MORTAL does not currently advertise adherence to a specific trade or professional code of conduct. If that changes, the relevant code and how to access it will be identified here.

6. Payment

Available payment methods are shown at checkout. You must provide accurate billing information and be authorised to use the payment method supplied. Payment is processed through Shopify and the provider shown at checkout.

7. Delivery

At launch we deliver within the United Kingdom. Production, dispatch, delivery estimates, charges and responsibility for parcels are explained in our Shipping & Delivery Policy. Unless a different period is agreed, goods will be delivered without undue delay and no later than 30 days after the contract is made.

8. Cancellations, returns and refunds

Online cancellation rights, the normal 14-day cancellation period for eligible standard goods, the following 14-day return period, return postage, refunds, faulty goods and the model cancellation form are in our Returns & Refunds Policy.

Prior approval is not a condition of a statutory cancellation where the law does not permit such a condition.

9. Faulty, damaged or misdescribed goods

Goods must be of satisfactory quality, fit for their usual or agreed purpose and as described. Statutory remedies can include rejection, repair, replacement, price reduction or refund depending on the circumstances and timing. A supplier's or fulfilment provider's internal rules do not reduce your rights against VAIN & MORTAL.

10. Changes or cancellation before dispatch

If you contact us quickly after ordering, we will try to accommodate an address correction or cancellation before fulfilment begins. Production can start soon after an order is placed, so an operational stop cannot be guaranteed. This does not remove statutory cancellation rights that otherwise apply.

11. Intellectual property

Unless stated otherwise, the VAIN & MORTAL name, branding, original artwork, graphics, photographs, written content and other original store materials are owned by or licensed to the store operator and protected by applicable intellectual-property laws. Buying a product does not transfer intellectual-property rights in its design.

12. Acceptable website use

You must not misuse the website, attempt unauthorised access, introduce malicious code, materially interfere with its operation, or use store content in a way that infringes intellectual-property rights.

13. Our responsibility to consumers

We do not exclude or limit liability where unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that consumer law does not permit us to exclude.

For a consumer purchase, we are responsible for loss that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for unforeseeable loss or business loss arising from a purchase made wholly or mainly for business purposes.

14. Events outside reasonable control

We are not responsible for delay caused by an event outside our reasonable control, but will take reasonable steps to minimise the effect and keep affected customers informed where appropriate. Statutory rights relating to excessive delay remain unaffected.

15. Privacy and cookies

We handle personal information under our Privacy Policy. Our Cookie Policy explains cookies and similar technologies.

16. Complaints and dispute resolution

You may complain by emailing support@vainandmortal.co.uk or writing to the address in section 1. Include the order number where relevant, enough information to understand the issue and the outcome you seek.

We will investigate fairly, may ask for information reasonably needed, and will keep you informed where a response is taking longer than expected. These steps do not limit a statutory right or remedy.

When we communicate the outcome of a complaint, we will identify any alternative dispute-resolution or other complaint-resolution arrangement available to you in which we are required by legislation or contract to participate, including the arrangement's name and website where the law requires that information.

You may obtain independent advice from the Citizens Advice consumer service. Nothing prevents either party from exercising a legal right or bringing court proceedings.

17. Which version applies

We may update these terms for future orders. The version supplied when we accept an order applies to that contract. A later website update does not change an existing contract. Contractual information for an accepted order changes only where the law requires it or you and we expressly agree. Mandatory rights remain unaffected.

18. Governing law

These consumer terms are governed by the law of England and Wales, without depriving you of mandatory protections that apply where you live. If you live in Scotland or Northern Ireland, you may also bring proceedings in courts that have jurisdiction where you live.
